Wills & Estates
An important part of managing one’s affairs is ensuring that you are taken care of according to your wishes. At Benjafield & Associates we are able to advise you on how to put in place the necessary documents to achieve those wishes.
Do you have a Will? Is your Will effective? Making sure your Will is correctly drafted is the best way to avoid uncertainty with your assets when you pass away. We can give advice on how best to avoid family provision claims, how to take care of your dependents, including how to set up testamentary trusts or grant life estates in property.
Have you been left out of a Will or feel that you have not been properly provided for by a loved one? We will give you a frank assessment of your situation and advise on whether you might be entitled to make a family provision claim or challenge the Will itself.
If you are an executor named in a Will, we can help you complete the documents involved in applying for probate of the deceased estate, and to deal with any claims on the estate by negotiation, alternative dispute resolution, or litigation as a last resort. If the deceased has passed away without a Will (called intestacy) and you are entitled to be an applicant to administer the estate we can explain the process to you and arrange for the appointment so that the assets may be dealt with.
